Terms of Service

We currently sell performance swim caps only:

• BEST Performance Dome Cap — a standard retail silicone cap sold through our online store.
• Custom BEST Performance Dome Caps — made to order with your club, school or squad branding.
• Custom BEST Seamless Caps — a separate custom silicone cap style, made to order.

Product features differ between styles. Features described for the BEST Performance Dome Cap, such as its contoured dome profile, do not automatically apply to Custom BEST Seamless Caps.

• Use the site lawfully and do not attempt to disrupt or gain unauthorised access to it.
• Keep your account details secure if you create an account.
• We may update, suspend or withdraw parts of the site at any time.

We aim to describe and photograph our caps accurately. Screen settings, photography and lighting mean the colour you see online may differ slightly from the finished silicone cap. Minor variation in colour, finish and print between production batches is normal and is not a fault.

• Prices are shown in Australian dollars and include GST where applicable.
• Shipping and any unavoidable fees are shown before you complete checkout.
• Discount codes apply only to eligible products, cannot be applied after an order is placed, and may be withdrawn or changed at any time before use.
• Only one discount code may be applied per order unless we state otherwise.
• Where a price is clearly wrong due to an obvious error, we may cancel the affected order and issue a full refund.

Your order is an offer to buy. A contract is formed when we accept your order and confirm it by email. If a product becomes unavailable after you order, we will contact you and offer an alternative, a wait, or a full refund of the affected item.

Custom orders are made to your specification and are governed by our Custom Team Orders policy, including minimum order quantity, artwork approval, production timeframes and cancellation.

• Minimum order quantity is 10 units per custom cap style.
• Production begins only after you approve the digital proof in writing.
• Full payment is required before production begins, unless invoiced terms have been agreed in writing.
• Production estimate: 4–6 weeks from written artwork approval. Production time is separate from delivery time.

By supplying a logo, crest, sponsor mark, athlete name or other artwork, you confirm that you own it or have permission to use it, and that producing caps with it will not infringe anyone else's rights. You keep ownership of your artwork.

We own our brand, website content, product photography, cap designs, moulds and production templates. You may not reproduce them without our written permission.

Reviews and content you submit must be honest and your own. Where you send us photos or video, or tag us publicly, we may ask for your permission before reusing that content in our marketing. Content involving a person under 18 requires parent or guardian consent.

• Shipping Policy — processing, delivery and tracking.
• Returns & Refunds — change of mind, faults and incorrect items.
• Warranty Policy — manufacturing defects and care.
• Pre-Order Policy — applies only when a cap is offered for pre-order.

Ambassador, affiliate and athlete arrangements are covered by our Affiliate & Ambassador terms and any individual agreement. Giveaways and promotions are covered by our Competition Terms.

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any claim relating to a product is limited to repairing or replacing the product, or refunding the amount you paid for it. Nothing in this clause limits liability that cannot be limited by law.

These terms are governed by the laws of Queensland, Australia, and the courts of that state have non-exclusive jurisdiction.
